A Separate Courtroom Cannot End the Wait

The redesign recognizes that justice is encountered through the body: through proximity, visibility, waiting and forced repetition. But a protected room can become institutional stage dressing if the same complainant remains trapped for years in an understaffed process.
The UK government has announced that specialist courts for rape cases will be rolled out across England and Wales. Funding will allow complainants to watch proceedings remotely and to give evidence by video from a separate room, reducing the need to occupy the same physical space as the defendant during some of the most exposed parts of a trial.
That material change deserves to be taken seriously. A closed door, a controlled camera and a room without the defendant’s immediate presence can alter breathing, concentration and the ability to speak. Remote viewing may also let a complainant follow the case without repeatedly entering a courtroom built around public observation and adversarial performance.
The administrative design remains just as important as the interior design. The reported announcement does not yet provide a complete public account of which courts will receive the facilities first, when every site will open, who qualifies to use each measure, how specialist staff will be retained or how funding will be divided. Those details will decide whether the protection is routine, rationed or dependent on geography.
The corridor before the room
Most of the attrition in a rape case does not begin at the witness chair. It accumulates during investigation, disclosure, charging decisions, conference dates and adjournments, against a backlog that can leave complainants organizing work, care and private life around a trial that keeps moving. A separate evidence room cannot correct a late file or supply an absent prosecutor.
There is an old institutional temptation to treat dignity as a matter of presentation: improve the room, soften the encounter, preserve the familiar machinery behind the wall. Here, privacy is material. So is elapsed time. Specialization will mean little if a more considerate hearing waits at the end of the same exhausting queue.
The government should therefore publish results by court and over time: the interval from report to charge and from charge to trial, the number of withdrawals and adjournments, the use of video evidence, verdicts and the reasons cases end early. Those figures should be read alongside complainants’ own accounts of safety, comprehension and control.
The measure of success is not whether the new rooms look calmer. It is whether fewer people are lost before reaching them, whether scheduled hearings proceed, and whether complainants leave able to explain what happened to their case without describing the process itself as another prolonged injury.
